TrinityForce Cane Corso Buyers Agreement
At TrinityForce Cane Corso, our commitment extends beyond breeding exceptional Cane Corsos; it encompasses their lifelong well-being and responsible placement. This meticulously drafted Buyers Agreement serves to articulate the shared responsibilities between the buyer and TrinityForce Cane Corso, fostering a transparent understanding of the adoption journey and the profound dedication required for a Cane Corso companion.
I. Health & Genetic Assurance
We stand by the robust health of our puppies, underpinned by the following terms:
- Eligibility for Guarantee: Our comprehensive Buyers Agreement is applicable to puppies or dogs purchased at their standard price. Discounted sales are excluded from replacement guarantees. A full purchase value of $2,500 is prerequisite for protection under this agreement.
- Initial Veterinary Examination: It is paramount that the puppy undergoes a thorough veterinary examination by your chosen veterinarian within 72 hours of its receipt. TrinityForce Cane Corso cannot assume responsibility for communicable diseases contracted after this initial three-day period.
- Genetic Health Guarantee (24 Months): We guarantee this puppy to be free from severe, life-altering genetic abnormalities for twenty-four months from the date of purchase. This guarantee specifically covers conditions that profoundly impact the dog's quality of life.
- Exclusions: This guarantee does not extend to breed-common conditions that typically do not severely affect the dog's overall health or longevity. These include, but are not limited to: cherry eye, minor dental irregularities, entropion, ectropion, or Grade 1 or 2 heart murmurs, and other conditions commonly found across all Molosser breeds. These conditions are considered cosmetic or minor and do not warrant replacement.
- Replacement Protocol: Should a severe genetic abnormality be diagnosed within the twenty-four-month period, a replacement puppy will be offered from the next available litter. A definitive genetic diagnosis must be collaboratively confirmed by two independent veterinarians (your veterinarian and a veterinarian designated by TrinityForce Cane Corso). For orthopedic or cardiac concerns, official certifications from organizations like OFA (for cardiac and elbows) or PennHIP (for hips) are required. Please note that OFA certifications alone will not suffice for hip dysplasia diagnoses under this guarantee.
- Voided Guarantee: No replacement will be provided for puppies or dogs that do not meet the specified criteria for replacement under this health guarantee.
II. Responsible Ownership & Care
The buyer's dedication to responsible care is integral to the health guarantee:
- Environmental Responsibility: Our guarantee does not cover injuries sustained by the puppy/dog due to environmental factors or owner negligence.
- Dietary Compliance: Buyers are responsible for feeding a non-raw diet, ensuring the protein content does not exceed 26%, calcium 1.3%, and phosphorus 1.0%. Scientific studies emphasize the critical importance of these nutritional thresholds for the healthy development of large breed puppies. Buyers must retain purchase receipts of the food fed, typically accessible via online order history, to validate the health guarantee.
- Weight & Physical Activity Management: Buyers are obligated to maintain a healthy weight for their puppy/dog. Gradual and safe physical activity is essential; owners must ensure the dog is appropriately conditioned for tasks to prevent injury. Young puppies should not be exposed to slippery flooring and stair climbing should be strictly limited until 5 to 6 months of age, and even then, such activities should be restricted. Strenuous activities like jogging or long-distance running are prohibited until the dog reaches at least two years of age, particularly for larger individuals, due to the protracted fusion of their growth plates.
III. Breeding Rights & Ownership Terms
Specific stipulations apply based on the purchased dog's breeding rights:
- With Breeding Rights: For dogs acquired with the potential for breeding rights, a rigorous set of requirements must be met before any breeding commences. The adult Cane Corso must undergo comprehensive health testing for elbows and hips (as certified by OFA or PennHIP) and achieve an AKC championship title by 24 months of age. Additionally, the dog must carry the "TrinityForce" prefix in its registered name (e.g., "TrinityForce's [Call Name]") on its AKC registration papers. Co-ownership with TrinityForce Cane Corso will remain in effect until all these requirements are fully satisfied. Upon completion and our verification, full ownership will be released, and the buyer may proceed with breeding without further obligation from our end.
- Breach of Breeding Terms: Should the dog be bred prior to fulfilling all aforementioned requirements, our health guarantee and contract shall be immediately void. Furthermore, the buyer agrees to surrender the dog back to TrinityForce CaneForce at their sole expense, with no compensation provided.
- Prohibition of Crossbreeding: Any crossbreeding of a TrinityForce Cane Corso dog with another breed is strictly forbidden. Breach of this clause will result in the immediate forfeiture of the dog back to TrinityForce Cane Corso, with no compensation made to the buyer.
- Without Breeding Rights (Limited Registration): All dogs acquired without breeding rights are issued with limited AKC registration. While we do not mandate neutering for male pups due to health considerations, all female pups are required to be spayed by 14 months of age. Failure to comply with the spaying requirement for female pups may result in the dog's confiscation at the buyer's expense, with no compensation. It is expressly forbidden to breed any dog purchased from TrinityForce Cane Corso without first obtaining full breeding rights. In the event a TrinityForce Cane Corso dog is bred without full breeding rights, TrinityForce Cane Corso has the right to reclaim the dog at any time, without compensation made.
- Legal Recourse: In the instance that legal action becomes necessary, all court proceedings shall be initiated and conducted within the breeder's state of residence. Any court fees incurred will be reimbursed by the buyer should the ruling favor the breeder.
IV. Deposit & Pick-Up Policies
- Deposit as Commitment: The deposit serves as a firm commitment from the buyer to purchase a puppy. Should the buyer decide against proceeding with the purchase, the deposit will be forfeited.
- Litter Guarantees: We cannot guarantee specific colors or genders within any particular litter. In the unforeseen event that a planned litter does not occur, or does not produce the anticipated number of puppies, the deposit will be seamlessly transferred to an alternate litter of your selection.
- Puppy Pick-Up: The deposit secures the puppy until it is fully weaned and ready for collection. Buyers are required to pick up their puppy by 8 weeks of age unless a written, mutually agreed-upon arrangement with TrinityForce Cane Corso specifies otherwise. A daily boarding fee of $25 will be assessed for each day the puppy remains in our care beyond 8 weeks, unless a prior written agreement supersedes this.
V. Conflict Resolution
- Compensation Policy: TrinityForce Cane Corso maintains a strict policy of no refunds for any monies paid. Any required compensation, as stipulated by the terms of this agreement, will exclusively be rendered in the form of a replacement puppy.
- Dispute Conduct: Buyers unequivocally agree to confine any disagreements or conflicts regarding TrinityForce Cane Corso solely to private communication with the breeder or to the appropriate legal court system, should such involvement become necessary. Buyers expressly agree to refrain from posting any disagreements or conflicts concerning the breeder on the internet or social media platforms. This clause is a vital safeguard for TrinityForce Cane Corso's reputation, acknowledging the potential for public opinion to be weaponized regardless of factual accuracy, and upholding the integrity of the judicial process as the appropriate venue for dispute resolution.
